What if I ran from the cops.....
........... got away, but someong on the road called in my plates?? Hypothetically speaking of course. So WHAT IF one was riding on the highway, so a cop coming up (knew the cop didn't get his plate) , took of through traffic on the highway, outrageous speeds and various illegal moves, but got away. Friends that were riding , but not as fast (he wondered why they were not keeping up) ,tell him cops came to the "spot" and told them that he had my plate number. Three and half hours later, nothing has happened...no calls, no knocks on the door. So IF plates were called in, what might happen?

Re: What if I ran from the cops.....
I'm in Texas, and like most states, the officer has up to 2 years to issue you a citation or write a warrant (that's the statute of limitations on a misdemeanor). What state are you in?
They can do one of four things: they can wait and see you out on the road later and write a citation, they can mail a citation to you, they can write a warrant and come get you later, or they can do nothing.

Re: What if I ran from the cops.....
In NY it's 1 year to issue a summons (citation). As far as mailing you a ticket or just showing up at your house with one...not a chance. An officer must have a positive identificatioin of an individual to issue a ticket or make an arrest at a later date, and with the helmet laws in NY, its nearly impossible here. An ID based on clothing would only be acceptable if the rider was caught in close proximity to the location almost immediately afterward.
So I'd hate say it, but if you run and get away, you're pretty much in the clear as long as you don't cause an accident or hurt anyone. I've had guys run on me, and we all know there's NO police car that can hang with our bikes...

Re: What if I ran from the cops.....
As the saying goes..your bike might be faster then the department car...but it isn't faster then the radios.
With just your plate, they might not arrest you because they don't know it's you they could, depending on the charges you racked up on your little tear through town decide to make life a little rougher and "claim" your bike as part of an ongoing investigation. What comes from that..who knows but you will be without it for a little while. Depending how busy your PD is..they can go pretty far with this..if they truly got your plate I would probably say you have every right to be nervous about it for at least the next few days.

Re: What if I ran from the cops.....
Good call PoPo, definitely could take the bike as part of the "investigation", really just trying to get it away from you, because you couldn't be properly identified...

Re: What if I ran from the cops.....
from the criminal justice classes i have taken i dont think someone calling in ur plates will do anything! i believe the term is called hearsay and just because someone says ur doing something does not give the cop the right to ticket or arrest u without seeing the crime happen with his own eyes!

That is not hearsay! Anything experienced firsthand by a witness is admissable. So for example, if I witness Tahoe and Sugi doing the nasty, that is admissable.
Hearsay is something that is not witnessed firsthand. Using the same example, if PoPo said, "Abad told me that he saw Tahoe and Sugi doing the nasty.", that would not be admissable. In order for that testimony to be entered into a trial, the court would have to subpoena me and have me enter that testimony.
So in this example, a witness calling in plates is admissable and enough for a police officer to cite (or arrest). However, if the witness does not present the testimony (whether firsthand or an affidavit), it would not be admissable. Of course, you (or your lawyer) would have the right to cross-examine this witness' testimony to discredit it in some way ("How far were you from the bike?", "What speed were you driving?", "If the bike was alledgedly going so fast, how were you able to see the plates?", "Even if your testimony were true, how do you know the rider was the defendant?").

Re: What if I ran from the cops.....
I live in Los Angeles, I seriously doubt they would have the time to do anything, I think it's all dependent on where you are and who you piss off. If I were a cop and I had the power to have your bike confiscated as evidence, I would do it. :) I have heard helicopters overhead less than a minute after the police sirens, though, and LAPD will beat you with nightsticks once they catch you, so I probably wouldn't even try it....

Re: What if I ran from the cops.....
just another thought..
even though we've all owned our bikes for a while, and we're supposed to have our plates by now... what kind of infraction, or violation can you expect to get for riding without a license plate?
i don't condone running from the police, or braking laws, but its passed my mind from time to time with all these damn photo sensor cameras at intersections.

Re: What if I ran from the cops.....
Just my two cents worth. I doubt that a cop would tell your friends that he had your number if he realy did. that would give you a chance to prepare an aliby of some sort. they usualy lay it wait you and give you as little to work with as possible, they don't like to lose! It could be that there tring to scare you into turning your self in. it hard to take back a confession.....
next time just stop...what isit worth to you? what if you wreck? what if the cop wrecks? what if you cause an accident and some poor sap gets hurt for no reason? how much can your consince take? just food for thought.....

My '07 600RR buddy got ticketed not too long ago - no windshield(windscreen? He had it in shop getting "Dr. Enuf" logo put on) and his license plate wasn't visible (rear fender delete kit had it nearly covered by back tire while seated). He doesn't have to pay so long as he shows the court that he's fixed the boo-boos. I wouldn't run stoplight cameras or speed in areas with cameras, though.

Re: What if I ran from the cops.....
Being an officer and a sportbike owner I try to cut other sportbikers as much of a break as I can, that being said.
An officer doesn't have to catch the person on the bike. They just have to get close enough to get your tag. Once thats done they can get all your info and issue a warrant for your arrest and soon you'll be getting a knock on your front door. Depending on who comes to serve the warrant. You may get a soft knock or a hard knock which would result in your door coming off the hindges.
As someone already stated. You most likely can out run a patrol unit. If you can ride better than the average person you can prolly lose the cops on a road with lots of corners, most of today's newer cops (me included) are being taught more tactical driving at the police academy than in the past. But none the less, you will not be able to outrun a radio. The state I work in, it doesn't matter about who's on your bike. If we get your plate number and you've so happen to loaned your bike to a friend who's running, its your bike so its your respondsibility. Same with DUIs.If you knowingly loan an intoxicated person your vehicle, you too will be charged with DUI.
Not to mention ppl talk so it wouldn't be hard to find out who owns a certain color bike. Then narrow it down from there. Just my $0.02, in the end its not worth the risk, money, jail time etc.and all just so you can tell your friends you ran from the cops. lol
I worked a sportbike wreck a few months back. Some 16 year old kid decided to run from the police and ended up hitting a road sign which severed his left leg completely off. I had to hold it on while EMS worked on keeping him alive.....like I said, it ain't worth the risk. You want to play, then expect to get caught, be a man and take the ticket and be done with it. Don't risk your life as well as others.
Ok I'm done preaching lol

Thats ridiculous, how can two people be changed with a DUI? doesnt it stand for DRIVING under influence? i never heard of two people driving a car at the same time. I think its just a money grabbing law, if my friend tells me he ok to drive who am i to judge if hes drunk or not, u really dont have to be drunk to blow over im not sure what the legal amount is in ur state but here its 0.08 which is not much at all, with that amount of alcohol i dont even think u even get a buzz. And as for somebody else running with ur bike u can always say u gave no permission, but u dont want to press charges to a thieft. Just my thoughts on this

Re: What if I ran from the cops.....
Well, first this is in the event that they dont get you at that time. Then they track the vehicle by its plates. if it was the owner then he gete pinched, if not then they want to know who....
As for the rest of your argument...its YOUR vehicle.......It is YOUR responsibility to make sure the person behind the wheel is compitant and sober. the limit is set so low because alcohol starts to have an effect on you reaction times at those levels. In a bad situation shouldnt you have as much control over your body as possible? For this reason law enforcement has adopted a zero tolerence to keep DUI's from causing DOA"s.
