Wheelie tickets

    Wheelie tickets

    Stupid me at 37yrs.old

    LEO pulled me over for a wheelie on an empty on ramp.
    Two tickets
    reckless driving 6 points
    and negligent driving.1 point
    The tickets have the box check for related citation so they are linked together.

    I admitted my error and the LEO was nice and we had a very civil conversation about my options.  LEO was thankful that I didn't run and said he would tell the judge I was very respectful and courteous.  I understand he was just doing his job.  No personal issue.

    My record
    First ticket having my motorcycle license and riding almost daily for 18 years (minus a speeding ticket that was thrown out)
    Car ticket maybe 5-6 years ago.  Record is clean.

    I can't deal with the reckless ticket.

    Questions
    1) I'm sure they can do whatever they want but two tickets for one offense?  Kinda like charged twice for the same crime.
    2) Should I just pay the negligent ticket and take the reckless to court?  I have already signed up for the Advance Motorcycle Safety course with the Motor Vehicles Administration.  Thought the judge may like that.

    3) I figure if I go to court I should list
    I commute 90 miles daily
    Clean record
    Completed (or signed up, depending on the date) for the Motorcycle safety class.
    Explain how 6 points may cost me my job working with the developmentally disabled.

    I work in Florida, but here we have reckless and careless driving.  Reckless is a willful and wanton disregard for the safety of other persons or property.  Careless is the failure to use due care.  IMHO, if I had observed what you described (assuming you're being honest), if I cited you for anything it would be careless.  If there were other cars around, pedestrians, school zone, etc. you'd be going to jail for reckless driving (it's a criminal offense here).  I don't know the law there but there is the chance he could have taken you to jail but decided not to.  The two tickets together seems a little redundant to me, but then again that may be commonly accepted in courts up there.  It could be a case where they always issue the two together.  It's up to you if you want to take it to court.  If you do, you could explain that you're willing to pay the careless but would ask that they withhold the point from your license.  Then explain that you feel the reckless ticket is redundant, and mention all those things you listed.  Depending on the judge you get, who knows.  Good luck.
