    town liabilties

    what are the chances of getting reimbursed by your town after getting a nail in your tire in a construction zone?

    Honestly, you would have to go through so much trouble to prove that the nail came from the construction zone and prove that the nail came from the construction crew itself. It is so much easier to just replace the tire. I've had so many nails in my car tire it's not funny. Now, i know that you can't patch a motorcycle tire (at least i wouldn't), but the easiest fix would be to get a new tire. Sorry!!!!

    This sounds like a question more appropriate for your local municipality than a police officer.

    Was the construction being done by a private contractor or a city/county crew? Either way you'd never be able to prove the nail came from thier construction site. Waste of time to pursue IMO.

    Yeah, thats a dead case man, not worth the trouble.
    I do want to know though about responsibility for road conditions.  In a couple of places around here I've seen DEEP potholes.  I mean so deep i'm pretty sure that if you didnt notice and were traveling at the speed limit of 35 you are definetely going to take a spill or go over the handlebars.

    Now that's a different story. If you were to crash due to poor road conditions get a good attorney. What ever government entity responsible for the upkeep of that road may be held liable.

    for the orginal poster that sucks but don't even bother man it's not going to happen, and you're just going to get more and more pissed off the longer you try to recoup your losses

    For fulcrum, yeah that's a definite win, if you can show that the town knew about the pothole and did nothing about it, whether that be fixing it or placing warning signs or cones around it.

    In order for the city to be liable for any damage to a vehicle, they must have been notified of the "problem" and given time to correct it.  If you call and say that there is scaffling in the road where the city is doing work on Monday and you get a scaffle footing picked up by your tire and thrown the the wheel well which pokes a series of holes in your fender THEN they are liable.  This happened to me, but they were "notified" of the danger before I hit it.

    Additionally, users of motor vehicle always assume some liablity to utilizing the streets.  Lost cause, however, you should think about getting your next tires from a company that insures them with "certificates".  I know you can buy the option at discount tire direct for like 20 a tire.  If they can't fix it, ie the side wall comes off, etc, they they replace it.
